This page explains how Marigold handles Personal Data for different groups of individuals and links to specific notices. It covers our Site Privacy Notice (for website visitors, prospects, and job applicants) and our Services Privacy Notice (for Customer data handled through the Services).

Site Privacy Notice

This Site Privacy Notice describes how we collect, use, disclose, and safeguard Personal Data when you interact with our websites (including meetmarigold.com). It applies to the following groups:

  1. Customers of Marigold – individuals who use our Services, or in some cases former users whose data is retained under this Notice.
  2. Website Visitors – any individual who interacts with our website(s), whether or not they are a Customer, Prospect, or Applicant.
  3. Prospects – individuals who have expressed interest in Marigold’s Services but are not yet Customers (treated as a subset of Website Visitors for this Notice).
  4. Applicants for employment – individuals who have applied for a position with a Marigold entity and are not currently employed by us.

1. Collection of Personal Data

Information you provide to us. Certain parts of our site may ask you to provide Personal Data (e.g., name, contact details, company name) when you request a demo, download content, or contact us. For Applicants, this can also include information submitted with a job application (e.g., resume/CV, email, phone number).

2. Why we process your information

  • To operate, maintain, and improve the Website and our offerings.
  • To respond to inquiries, deliver requested content, and provide support.
  • To contact you with marketing and promotional information in accordance with your preferences and to provide advertising on third-party sites based on your browsing on our Website (see “Controlling Your Personal Data” below for opt-out controls).
  • For security, fraud prevention, legal compliance, and to enforce our terms.

3. Legal bases (EEA/UK/Switzerland)

  • We typically rely on our legitimate interests to collect and process Personal Data for our own purposes, except where overridden by your data-protection interests or fundamental rights and freedoms.
  • In some situations we may rely on consent, be under a legal obligation, or need to protect vital interests.

4. Data retention

We retain Personal Data while we have an ongoing legitimate business need (e.g., to provide requested information or meet legal, tax, or accounting requirements). When we no longer have such a need, we will delete or anonymize the data, or if that’s not possible (e.g., backup archives), we will securely store and isolate it until deletion is possible.

5. Cookies and similar technologies

Our Website uses cookies and similar technologies for functionality, analytics, personalization, and advertising. You can manage your cookie preferences via your browser settings and, where provided, our on-site preferences tools. Note that disabling certain cookies may affect site functionality.

6. Controlling Your Personal Data

You can retrieve, access, amend, or delete your Personal Data by submitting a request via our individual rights portal. We may request additional verification to complete your request.

Rights for EEA, Switzerland, and UK residents

  • Access, review, change, update, or delete your Personal Data.
  • Object to processing, request restriction, or request data portability.
  • Withdraw consent where processing is based on consent.
  • Lodge a complaint with your local data protection authority (e.g., EEA DPAs or the UK ICO).

7. California disclosures

Selling and Sharing of California Consumer Personal Data. We do not believe our processing activities constitute “selling” under the California Privacy Rights Act (CPRA). When you visit our Websites, you are interacting with Marigold, and Marigold employees process Personal Data under a unified strategy to meet Marigold’s objectives.

8. Security

We use appropriate technical and organizational measures to protect Personal Data. However, no Internet transmission is 100% secure. We encourage you to use available tools (e.g., firewalls, secure email) and take care when disclosing Personal Data online.

9. International data transfers

Marigold is located in the United States and may process Personal Data there and in other countries. We implement appropriate safeguards (including the European Commission’s Standard Contractual Clauses for EEA/UK transfers) to help ensure a level of protection consistent with this Notice. We can provide more details upon request.

10. Changes to this Site Privacy Notice

We may revise this Notice to reflect legal, technical, or business developments. When we update it, we will take appropriate measures to inform you, consistent with the significance of the changes, and obtain consent where required by law.

Services Privacy Notice

This Services Privacy Notice explains how Personal Data is processed when Customers use Marigold’s Services. In many cases, Marigold acts as a processor on behalf of its Customers (the data controllers). If you are a data subject of a Marigold Customer and want to exercise your privacy rights, please contact the relevant Customer (controller). If you have difficulty identifying them, you can write to privacy@meetmarigold.com.

1. Electronic messages sent using the Services

When a Customer uses the Services to send electronic messages (e.g., email, SMS/MMS, other messages), Personal Data is processed to deliver and measure those communications. Typically, Marigold processes:

  • Information provided to us as a service provider by Customers (e.g., email addresses, phone numbers, unique identifiers and any other data the Customer chooses to include for personalization, measurement, or recordkeeping).
  • Service logs and related data generated by operation of the Services, used to operate, secure, and improve the Services, resolve issues, enforce the Services Agreement/AUP, and meet legal obligations.

Role. With respect to sending messages, Marigold acts as a processor and processes Personal Data solely on the Customer’s instructions. Customers may use Personal Data collected via the Services (including tracking technologies configured by the Customer) to identify/segment audience, target advertising, and measure performance, as determined by the Customer.

2. Legal bases (EEA/UK/Switzerland)

Where Marigold processes Personal Data for its own purposes related to operation of the Services (not on behalf of a Customer), we typically rely on legitimate interests, except where overridden by your data-protection interests or fundamental rights and freedoms. In some cases, we may rely on consent, legal obligation, or vital interests.

3. Data retention

We retain Personal Data while we have an ongoing legitimate business need (e.g., to provide requested Services or meet legal, tax, or accounting requirements). When there is no such need, we delete or anonymize data, or securely store and isolate it until deletion is possible.

4. Individual privacy rights

If you are a Customer Data Subject, Marigold (as processor) is not authorized to act on your request unless instructed by the Customer (controller). If you believe Marigold is acting as a controller, please refer to the Site Privacy Notice and use the Rights Portal to submit a request.

5. Security & international transfers

Subject to the Services Agreement and applicable Ordering Document(s), Services may be provided, supported, and hosted in the United States. Where required, we implement safeguards for cross-border transfers, including the European Commission’s Standard Contractual Clauses for EEA/UK transfers, to help ensure a level of protection consistent with this Privacy Notice.

6. Changes to this Services Privacy Notice

We may update this Services Privacy Notice to reflect legal, technical, or business developments. When we do, we will take appropriate steps to inform you and obtain consent where required by applicable law.
